Joel Leebove filed a class action against Wal-Mart Stores Inc. for allegedly violating Civil Code Section 1747.08, the Song-Beverly Credit Card Act. Leebove filed a motion for class certification.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Wal-Mart violated the Act by requiring customers to provide a telephone number, and sometimes, their address, in order to complete a transaction.

Damages

The class action sought in excess of $5 million in damages.

Result

The Hon. Manuel L. Real of the Central District of Court denied Leebove's motion for class certification.
