Facts

On Oct. 25, 2007, plaintiff Felicia Arrington, was proceeding northbound in a 1997 Nissan Sentra on the 170 freeway, north of Whitsett Avenue in Los Angeles. Defendant Mary McLeod's vehicle sustained a blow out while in the carpool lane, causing her to lose control of her vehicle and veer to the right into traffic and collide with plaintiff's vehicle. The impact between Arrington's and McLeod's vehicles pushed Arrington's vehicle to the right as well, which was then struck from behind.

Contentions

PLAINTIFF'S CONTENTIONS:
Arrington contended that McLeod's violation California Vehicle Code section 22107 was the cause of the accident and Arrington's injuries and damages.

DEFENDANT'S CONTENTIONS:
The defense disputed the amount of Arrington's medical bills and treatment.

Damages

After Arrington's treating physicians placed her off from work, she was unable to work between Jan. 25, 2007 to March 24, 2008 and July 29, 2008 to Jan. 16, 2009 and lost wages. During this time, Arrington received some compensation by the use of disability pay through her employer.

Injuries

Arrington sustained injury to her right hip, right shoulder neck, lower back and left knee, along with facial pain, headaches, anxiety and depression. The injuries required plaintiff to undergo medical evaluations, physical therapy, pain management, one epidural injection and psychological counseling.

Result

The case settled for $42,000.
