Facts
On June 21, 2007, plaintiff Suzanne Heredia was visiting the home of her parents, defendants Ronald and Louise Koon, when she tripped and fell over a raised portion of their driveway. Before the accident, the driveway had been improperly repaired by defendants resulting in further separation of the concrete slabs.
Contentions
PLAINTIFF'S CONTENTIONS:
Heredia contended that defendants' driveway was defective and dangerous and that defendants had actual notice of the condition. She further contended that defendants had attempted to remedy the driveway before the accident but only worsened the condition.
DEFENDANT'S CONTENTIONS:
Defendants contended that Heredia was aware of the condition of the driveway and was comparatively negligent.

Injuries
Heredia fell forward, landing on her right knee, causing a tear of the medial meniscus, sprain of the right knee and joint effusion. Surgery was recommended but was not performed because Heredia did not have medical insurance.
Result
The case settled for $300,000 (policy limits).
