Plaintiff Rhonda Gray was rear-ended by a vehicle driven by defendant Dean Kendrick while stopped at a red light near the intersection of Shaw Avenue and Golden State Highway in Fresno on Feb. 18, 2007.
Gray filed suit against Kendrick, alleging motor vehicle negligence.
Kendrick admitted liability.
Damages
Gray sought special damages plus $15,000 for past pain and suffering, $30,000 to $40,000 in future medical expenses, and $10,000 for future pain and suffering.
Injuries
Gray claimed she suffered soft tissue injuries to her neck as well as back strain and permanent ligament damage at C4-5, resulting in loss of vertebral motion segment integrity. She further claimed a permanent impairment rating of 25-28 percent, and 26-28 percent whole person impairment. Gray contended she would need chiropractic treatment three times monthly for her lifetime for her daily pain.
