On Nov. 20, 2008, Diane Wright stopped for slowing traffic while driving eastbound on Interstate 80 in Vacaville when her vehicle was hit by a truck. The truck was driven by defendant Edward Robison, who was in the course of his employment with defendant Sheedy Drayage Inc.

Wright's children filed suit against Robison and Sheedy Drayage, alleging motor vehicle negligence and vicarious liability.

Contentions

PLAINTIFFS' CONTENTIONS:
Wright's children contended that Robison was driving at a dangerous speed and was inattentive, causing the accident.

DEFENDANTS' CONTENTIONS:
Robison alleged that two other drivers, Stephanie Engelbrecht and Robert Jones, were also responsible for the accident, after stopping ahead of Wright and coming into contact with each other.

Damages

Wright's children sought damages for loss of society as well as Wright's pain and suffering.

Injuries

Wright was cut from her vehicle, which was crushed, and airlifted to the hospital with severe head, brainstem, back, and pelvic injuries, which she died from five days later.

Result

The parties reached a settlement for $2.4 million.
