Gabe Terry and Elena Terry sued the City and County of San Francisco and Chung Enterprises LP, in connection with an incident that occurred on Nov. 14, 2011.

Contentions

PLAINTIFF'S CONTENTIONS:
Gabe Terry was injured as he stepped onto a curb at the corner of Kearny and Clay Streets in San Francisco. Terry contended that defendants were liable for his injuries for negligent maintenance and improper design of the premises.

DEFENDANTS' CONTENTIONS:
The city denied any liability and asserted various affirmative defenses.

Damages

Elena Terry sought damages for loss of consortium.

Injuries

Terry sustained three fractures to his right ankle.

Result

The parties settled for $125,000.
