Anthony Held sued Battenfeld Technologies Inc., for alleged violations of Proposition 65.

Contentions

PLAINTIFF'S CONTENTIONS:
Held alleged that Battenfeld manufactured or otherwise distributed for sale in California bags with vinyl/PVC interiors that contain lead, a chemical known to cause defects or other reproductive harm, without providing the requisite warnings under Proposition 65.

DEFENDANT'S CONTENTIONS:
Battenfeld maintained that it has complied with all laws.

Result

The parties agreed to enter into a consent judgment that provided for injunctive and monetary relief. Battenfeld agreed to provide the requisite warnings, and to pay $4,000 in civil penalties. Battenfeld was also ordered to pay Held $25,000 in costs.
