Jennifer Kertzman sued Steven Cavanaugh in connection with a motor vehicle accident that occurred on Jan. 19, 2013.
Contentions
PLAINTIFF'S CONTENTIONS:
Kertzman claimed that she was a passenger in a car operated by Steven Cavanaugh. Kertzman contended that Cavanaugh hit a bus as he attempted to make a left turn at an intersection. She was injured as a result, and sued Cavanaugh for negligence. Kertzman contended that Cavanaugh caused the accident by failing to yield to the oncoming truck. As a result, a bus broadsided their vehicle.
DEFENDANT'S CONTENTIONS:
Cavanaugh disputed the extent of Kertzman's injuries.
Damages
Kertzman sought $101,490 in past medical expenses and an unspecified amount for pain and suffering.
Injuries
Kertzman was diagnosed with a disc bulge in her neck. She treated with a chiropractor and received three epidural shots. Eventually, she received surgery on her neck.
Result
The parties reached a $300,000 settlement, which represented Cavanaugh's policy limits.
