Specialized Bicycle Components Inc. filed a complaint against Christian Mangune dba Bluemoon Bike Bazaar, seeking a permanent injunction.
Contentions
PLAINTIFF'S CONTENTIONS:
Specialized manufactures high-end professional and recreational bicycles, including accessories and apparel. Specialized contended that its product bore the "Specialized" and "S," marks, which were federally registered trademarks, and that its brand had earned a good reputation.
Specialized claimed that defendants produced and counterfeited products bearing the Specialized and/or S trademarks, or confusingly similar marks. Specialized claimed that defendants took advantage of Specialized's success, and profited from its wrongful act.
Result
The court issued a permanent injunction against defendants, enjoining defendants from, among others, distributing or otherwise offering for sale any product that uses Specialized's trademarks or any marks that are confusingly similar to Specialized's trademarks.
