Facts

UBS Financial Services Inc. filed a complaint against William Northend alleging breach of contract; common count for money lent to respondent; and common count for account stated, related to promissory notes executed by respondent.

Respondent filed a counterclaim against UBS alleging fraud, negligent misrepresentation, suppression of fact, and breach of oral contract related to his employment with claimant.

Damages

UBS sought $286,757 in compensatory and/or consequential damages plus interests costs and fees. Northend sought unspecified amounts in compensatory and consequential damages; general damages; punitive damages; and costs and fees.

Result

All of UBS's claims against Northend were denied. UBS was found liable to respondent for $42,870 in attorney fees and $3,518 in costs pursuant to the parties' contract. All other claims by Northend were denied.
