Facts
On July 25, 1995, plaintiff Bob Lopez, a 66-year-old independent trucker, was unloading freight at defendant Certified Grocers of California's warehouse when he was knocked down by a forklift which was backing up. The plaintiff's foot was caught under the forklift and run over. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a settlement demand for $350,000. The defendant made a settlement offer of $30,000, raised to $50,000 before trial.
Injuries
The plaintiff alleged he sustained broken bones in his foot, a ruptured flexor tendon in his big toe, requiring possible future surgery, and back pain. Per the defendant, the plaintiff claimed loss of earnings and loss of earning capacity.
