On June 16, 1994, decedent Floyd Keith, a 69-year-old nursing home patient with Parkinson's disease, was referred by the defendant nursing home to the defendant dentist, Paul Kutz, D.D.S., for bilateral tooth extraction. The defendant placed gauze pads on the extraction site and then returned the decedent to the nursing home staff for further care. Several hours later, the decedent choked on the gauze pad and died. The plaintiff, the decedent's widow, brought this action against the defendants, the dentists and nursing home, based on negligence and dental malpractice theories of recovery. The nursing home settled prior to the arbitration.
