On July 27, 1992, plaintiff Billie Carol Flegel, a 46-year-old homemaker and apartment manager, was a passenger in a vehicle that stopped to make a left-hand turn. The vehicle in which she waqs a passenger was rearended by a truck operated by defendant Charles Bryant. Both front and back seats were broken and there was substantial damage to the vehicle in which the plaintiff was a passenger. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
