Facts

On April 20, 1994, plaintiff Rhea Colgan, a 23-year-old data entry clerk, and a regular patron at the defendant Santa Clara Lanes bowling alley, stepped through a puddle of spilled liquids located between the snack area and the bowling lanes. The spill was the result of a waitress dropping a tray of cocktails and soda. After the plaintiff stepped through the puddle, she immediately went to the bowling lane, picked up her ball and began to bowl. As she was releasing the ball, her left foot got stuck on the runway. The plaintiff claimed she immediately felt a twisting and burning sensation in her left knee. The plaintiff fell to the ground in pain. The plaintiff brought this action against the defendant based on negligence and premises liability theories of recovery.

Injuries

The plaintiff alleged she sustained a collateral ligament strain, internal derangement of the left knee, focal fibrosis and 1+ medial joint line tenderness. The plaintiff underwent exploratory knee surgery wherein a lateral release was performed. The plaintiff claimed that approximately 10 months later, scar tissue developed, requiring a second lateral release.

The award was rendered approximately 11 months after the case was filed. Two-hour arbitration was held on Jan. 23, 1997 before Ralph Rubenstein, Esq. resulting in the reported award.
