Facts
On Jan 2., 2004, minor plaintiff presented to the emergency room at defendant Riverside County Medical Center, and was seen by defendants Ganna L. Breland, D.O., and David M. Englander, M.D. Plaintiff had a ventriculoperitoneal shunt from post-hemorrhagic hydrocephalus, and the shunt was protruding out of her rectum. She was evaluated and released.
On Jan. 11, 2004, plaintiff presented again to the emergency room again because of problems with the shunt. The area of the shunt had become infected and surgery was performed to remove the shunt.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that defendants' treatment fell below the standard of care. Plaintiffs' also alleged negligent infliction of emotional distress.
Injuries
Plaintiffs claimed infection, surgery, and emotional distress. Plaintiffs further claimed that the minor plaintiff regressed in her development following the surgery.
Result
The parties settled for $200,000, plus $35,090 in attorney fees and $19,639 in expenses.
