Facts
Minor plaintiff was a student at Freedom Middle School of the Rosedale Union School District in Bakersfield. While attending Freedom Middle School, plaintiff claimed she suffered continuous harassment, both verbal and physical, by students at the school. She sued the school district claiming the school did not act reasonably to protect her from the abuse.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she was attacked due to the perception that she was a lesbian. Plaintiff claimed she was physically battered by a group of students on one occasion at a nearby park. During lunch hour on another occasion, plaintiff claimed she was repeatedly kicked by a group of four students. Plaintiff alleged that school officials were aware of the harassment but failed to act.
Injuries
Plaintiff claimed emotional distress; humiliation; depression; anxiety.
Result
The parties settled for $9,999.
