Facts
On June 7, 2007, plaintiff Terra White, a 29-year-old claims adjuster, was driving her car in Patterson traveling eastbound on Sperry Road. As she entered the Ward Avenue intersection, a police vehicle driven by a Patterson Police Department officer entered the intersection and collided with plaintiff's vehicle. The California Highway Patrol determined that the officer ran through a red light while responding to a non-injury accident located outside of the officer's jurisdiction. Plaintiff sued the Stanislaus County and the city of Patterson for vicarious liability.
Contentions
PLAINTIFF'S CONTENTIONS:
White contended that the officer entered the intersection on a red light and was speeding.
DEFENDANT'S CONTENTIONS:
The defense admitted liability but contested plaintiff's injuries.
Damages
White claimed medical costs of $180,000 and lost wages of approximately $10,000.
Injuries
White claimed head injury, compression fracture of her spinal cord, lacerated spleen, metacarpal fracture, ulnar syloid facture, triaquetral bone fracture, left radius fracture, and unconsciousness. White's husband claimed loss of consortium.
Result
The case settled for $675,000.
