On March 12, 2006, Angelica Araujo was sitting in the front passenger seat of a SUV driven by her husband when it collided with a 1999 Daewoo driven by Dana Manan and owned by Melissa Sherman.
Settlement Discussions
On Jan. 23, 2009, Manan and Sherman offered to settle with Araujo via C.C.P. Section 998 for $15,000.
Injuries
Araujo claimed that she suffered a torn left rotator cuff.
Result
The jury found that Araujo incurred $3,000 in past medical expenses but was 49 percent at fault. They found Manan was 51 percent at fault and reduced the award accordingly to $1,530. In light of the C.C.P. offer to settle, the court awarded Manan and Sherman $17,793 in costs.
