Facts

On Jan. 30, 2006, John Donnelly, 7, was walking his dog on a leash in a park. Defendant, Gale Darling, took both her dogs off their leash and one dog jumped and knocked Mr. Donnelly to the ground fracturing his hip and femur. Mr. Donnelly was hospitalized and operated on days later. He was in a wheelchair for months before using a walker and finally a cane. Plaintiff had two prior hip surgeries. He had an excellent recovery after surgery.
