Claimant Jose Jesus Torres, age 64, suffered from night sweats and high blood pressure. An adrenal mass was identified on C.T. On March 29, 2004, Claimant underwent a core biopsy of the mass, a functioning adrenal gland tumor, at Kaiser Hospital West Los Angeles. As a result of the biopsy, Mr. Torres suffered a hypotensive crisis and cardiac arrest, resulting in spastic partial plegia.
Contentions
CONTENTIONS:
Claimant contended that the standard of care was breached by failing to stabilize the patient medically before performing an invasive procedure. The specific tumor should have been identified and removed without biopsy.
