Alison Anderson sued Olivia Johnson, in connection with a motor vehicle accident.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was driving along Ruth Dr. in Newbury Park when defendant, who was turning left into a driveway, struck her vehicle. The force of impact caused plaintiff to hit a nearby parked van. Plaintiff sustained injuries and sued defendant for negligence. Plaintiff contended that defendant failed to yield the right of way to her.

DEFENDANTS' CONTENTIONS:
Defendant blamed the accident on plaintiff, alleging plaintiff was speeding and failed to pay attention to the traffic ahead. Defendant also disputed the extent of plaintiff's claimed injuries.

Settlement Discussions

Anderson made a CCP 998 demand for Johnson's policy limits of $100,000. Johnson countered with a CCP 998 offer of $25,000.

Damages

Anderson requested $15,000 in past medical expenses and damages for past and future lost earnings and pain and suffering.

Injuries

Anderson allegedly sustained a concussion as well as soft-tissue sprain and strains to her left leg, left arm, back, and neck. She underwent acupuncture and chiropractic care. Despite receiving treatment, she continued to experience pain and memory loss, affecting her daily activities.

Result

The jury rendered a verdict in favor of Anderson and awarded her $191,029 in damages, consisting of $15,029 in past medical expenses, $12,000 in past lost earnings, $24,000 in future lost earnings, $60,000 in past non-economic loss, and $80,000 in future non-economic loss.
