On Feb. 15, 2013, plaintiff Eduardo Urbano, a refuse hauler, was injured at Lamb Canyon landfill in Riverside when the wind caught the door of an adjoining truck, which struck him on the head. Plaintiff was in the course and scope of his employment with Burrtec.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended a Riverside County employee negligently directed the trucks to park too close together in windy conditions, creating a dangerous condition. Plaintiff claimed the county employee sequenced the docking of the trucks too quickly further endangering the drivers.
DEFENDANT'S CONTENTIONS:
Defendant contended the county employee did not direct the trucks and that the spacing was the responsibility of the drivers.
Injuries
Plaintiff claimed he suffered a traumatic brain injury.
Result
Plaintiff's verdict for $13,583,202. The jury found the plaintiff's employer 40 percent responsible for the injury.
