Joshua Rice sued the County of Los Angeles, Curt Messerschmidt, Sergio Patino, Andrew Hernandez, and Luis Mendoza, in connection with alleged civil rights violations.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Jan. 13, 2013, he was hiding in a garage from defendant officers who accused him of committing a crime. The officers then dispatched a canine and ordered the dog to attack plaintiff. Plaintiff was bit in the leg while defendant officers continued to yell orders at the dog to attack him. Plaintiff sustained serious, disabling injuries as a result and sued defendant for violating his civil rights. Plaintiff also accused defendants of failing to render prompt medical care that was not only reasonably but also necessary.
DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses.
Result
The parties reached a $50,000 settlement.
