Facts
On May 3, 2012, plaintiff Javier Concha was working as a highway traffic controller on the SR-91 Freeway. As plaintiff was at the rear of the truck placing cones, his truck was rear-ended by a drunk driver.
This was an Underinsurance Motorist claim after the underlying liability claim settled for $100,000.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiff claimed complex fracture of the right wrist, which caused him to have a diminished earning capacity. Plaintiff further contended that there was going to be need for future medical treatment, including possible future surgery.
DEFENDANT'S CONTENTIONS:
Defendant disputed the nature and extent of plaintiff's injuries and disputed plaintiff's loss of earning capacity claim.
Result
The case settled for $200,000 new money.
