PLAINTIFF'S CONTENTIONS:
Plaintiff alleged defendant struck her vehicle twice as they drove along State Route 85 in Santa Clara. Defendant was driving in the lane next to her when the collisions occurred. Plaintiff sued defendant for negligence, alleging defendant made an unsafe lane change thereby causing the accident.
Settlement Discussions
Lamping demanded $35,000 in settlement. Yen offered to settle the dispute for $8,500.
Damages
Lamping sought $12,670 in medical expenses and recovery for pain and suffering.
Injuries
Lamping's thumb was caught in the steering wheel, causing a partial dislocation and a possible torn tendon or ligament. The doctor placed her thumb in a cast and followed up with physical therapy. Despite years of cast and therapy, plaintiff claimed she continued to experience pain, limiting her ability to use her right hand.
Result
The parties ultimately reached a $27,500 settlement.
