Facts

On Oct. 12, 2013, plaintiff, Ralph Olivero, 61, was a pedestrian in an unmarked crosswalk at 6th Street and Jessie Street in San Francisco. While plaintiff was crossing 6th Street, a taxicab driven by Colden Struggs struck him.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed he sustained significant personal injuries as a result of the accident. Plaintiffs argued that the evidence indicated that Struggs was exceeding the speed limit.

DEFENDANT'S CONTENTIONS:
Defendants claimed that plaintiff caused his own injuries by failing to safely cross the street.

Settlement Discussions

Plaintiff issued a CCP 998 offer prior to trial in the amount of $1,999,999.

Injuries

Plaintiff spent six weeks in the hospital as a result of his injuries. Plaintiff claimed long-term orthopedic injuries.
