Air Alliance Houston sued Gina McCarthy, the administrator of the U.S. Environmental Protection Agency.

Contentions

PLAINTIFF'S CONTENTIONS:
Air Alliance alleged that the EPA had failed to perform its obligations under the Clean Air Act, and had not reviewed and revised national emission standards for petroleum refineries. It argued that the EPA had an obligation to review and promulgate new standards, but had not done so.

Result

The parties agreed to enter a consent decree to settle the case. The EPA agreed to review and revise emission standards, as required by the Clean Air Act. Plaintiffs would also be able to seek attorney fees and costs.
