On Dec. 21, 2009, plaintiff Hillary Millard was passenger in a vehicle that collided with a vehicle driven by Marisol Sanelias. Millard sued Sanelias, and the vehicle owner, Patricia Sanelias.

The plaintiff later dismissed Patricia Sanelias and the case proceeded to trial against Marisol Sanelias only.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she was a passenger in vehicle, which was driving on Route 76 in Oceanside, and when the vehicle stopped at a red light, Sanelias rear-ended it. Plaintiff claimed Sanelias drove in a negligent manner and that Patricia should be legally responsible for her injuries.

DEFENDANT'S CONTENTIONS:
Defendants claimed that the crash brought about nominal injuries, which did not need much treatment, and that plaintiff sought an excessive amount for physical therapy.

Settlement Discussions

Plaintiff sought $20,000 under CCP Section 998 and the defense offered $5,665 under CCP Section 998.

Damages

Plaintiff sought compensation for her past medical expenses, the loss of use of her vehicle, and lost earnings. She further sought pain and suffering damages.

Injuries

Plaintiff suffered back and neck injuries and received chiropractic care and physical therapy.

Result

The jury awarded plaintiff $8,295.

Other Information

In connection with post-trial proceedings, plaintiff recovered $5,000 in costs from the defendant.
