Jesus Manriquez, Evelyn Manriquez, and Jenny Coronel-Manriquez sued Joe Heidrick Enterprises Inc. in connection with a motor vehicle accident that occurred on Nov. 26, 2008.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that on Nov. 26, 2008, Jesus was driving in Woodland with his daughter, Evelyn, in the front passenger seat, a crash occurred with a truck operated by Jesus Manrique, who worked for Joe Heidrick. Plaintiffs contended that defendant driver lost control of his chemical tank truck, causing it to veer sideways across the road. Consequently, defendant driver was unable to avoid a collision. Plaintiffs claimed negligence and vicarious liability. Plaintiff's wife, Jenny, filed a derivative claim, seeking recovery for loss of consortium.

DEFENDANT'S CONTENTIONS:
Joe Heidrick did not dispute liability.

Damages

Plaintiff sought $351,000 in lost earnings and $171,000 in past medical costs. Evelyn sought $102,000 in past medical costs.

Injuries

Plaintiff injured his right ankle, right knee, ribs, nose, scalp, and ribs. He underwent surgery on his knee. He received extensive therapy for his injuries. Evelyn suffered suffered a fractured her right clavicle, and her spleen was lacerated.

Result

The parties agreed to settle for $1.8 million, which included $1,525,000 for plaintiff Jesus, $225,000 for Evelyn and $50,000 for Jenny's loss of consortium claim.
