Facts

The City of Santa Ana sued Elks Building Association of Santa Ana and Saddleback Inn LCC, which held a leasehold interest in the subject property, seeking to place the Saddleback Inn, which had been vacant and closed for business for six years, under a receivership, citing dangerous and unsafe conditions. The property had been vacant after a fire destroyed the south building, and it was demolished in December 2012.

Previously, an Orange Country judge ordered the City to allow the owners of the property to repair the property after the City ordered it demolished. However, the owners failed to repair or abate the problems. Then this lawsuit seeking for an appointment of a receiver followed.

Result

Superior Court Judge John C. Gastelum appointed a receiver for the inn, with instructions to prepare plans for the old hotel's demolition or repair.
