Newport Coast Securities Inc. filed an arbitration claim against Deborah Ann Scott, who filed a counterclaim and third-party claim against third-party respondents Joseph Mangiapane, Kathleen McPherson, and Stephen Washburn, in relation to Scott's employment with Newport Coast as President and Chief Compliance Officer, as well as her termination from the company.

CLAIMANT'S CONTENTIONS:
Claimant alleged Scott engaged in job performance transgressions, as well as violations policy and procedures. Newport Coast denied the allegations made in the counterclaim, as did the third-party respondents.

RESPONDENT'S CONTENTIONS:
Scott denied the allegations, and filed a counterclaim alleging wrongful termination in violation of public policy, fraud, negligent misrepresentations, conspiracy to retaliate and wrongfully terminate, breach of contract, defamation, breach of the implied covenant of good faith and fair dealing, unlawful age discrimination, and negligence.

Damages

Newport Coast sought $600,000, and $250,000 in punitive damages. Scott asked for $1 million in punitive damages.

Result

The arbitration panel awarded Scott $300,000 in compensatory damages and $125,863 in attorney fees against Newport Coast, Mangiapane, McPherson, and Washburn jointly and severally.
