Facts

Stockton Black Leadership Council and former Stockton mayoral candidate Ralph White filed suit against the City of Stockton seeking clarity on term limits in the city charter. The charter provided that "No person elected as either Mayor or Councilmember shall be eligible to serve, or serve, as either Mayor or Councilmember for more than two (2) terms." White argued that this limited a person from serving no more than two terms total at City Hall.

Result

San Joaquin County Superior Court Judge Lesley Holland found the judgment vague and ambiguous, but declined to side with White. Judge Holland did not find any legal reason to enforce term limits as White had argued. Hence, Judge Holland found in favor of the City.
