Facts
On March 26, 2010, Gamanial Jekisondas Shah, a relative of Jaishree Sheth and Prakash Sheth, a married couple, was driving the couple to the airport in Orange County when an 18-wheel truck operated by Schneider National Carriers Inc. improperly attempted to pass the car and corseted over into the other car's lane. A collision occurred, and the Sheth's car spun out of control across the freeway and crashed into the median barrier, where another car, driven by Betty Jean Onley, hit it.
The Sheths sued Schneider for personal injuries.
Settlement Discussions
Schnieder National Carriers offered $250,000 to plaintiffs Jaishree Sheth and Prakash Sheth. Schnieder National Carriers offered $60,000 to defendant Betty Jean Onley before trial.
Injuries
Jaishree Sheth suffered a C5-6 spinal fracture, and spinal chord injury. She also received two surgeries, and experienced respiratory failure. Onley suffered soft tissue, neck and back injuries as well as right shoulder rotator cuff syndrome with loose bodies requiring surgery.
Result
The jury awarded $36,482,303 to plaintiffs Jaishree Sheth and Prakash Sheth, and awarded $1,363,580 to Betty Jean Onley.
