Facts

Chris Burtleson was exiting his apartment at Garden Vista Apartments when he fell down a flight of 20 concrete stairs, injuring his back. Burtleson sued Richard Gherman, the owner of the property, and Select Property Management, the employer of the on-site property manager. He alleged that there was rotten wood on the landing and a loose metal strip on the stairs. He claimed that the defendants knew of the faulty condition but failed to repair them, creating a dangerous condition.

The defendants admitted a breach of their duty.

Injuries

Burtleson suffered an aggravation of a pre-existing lumbar condition and cervical strain injuries.

Result

The jury awarded Burtleson $434,900.
