Ubiquiti Networks Inc. filed a complaint against Kozumi USA Corp. alleging trademark infringement, counterfeiting, computer fraud, copyright infringement, unfair competition, false advertising, and libel. Kozumi filed counterclaims alleging federal and state antitrust violations, defamation, tortious interference, and violation of the Unfair Competition Law. Ubiquiti filed a motion to dismiss Kozumi's counterclaims.

Result

U.S. District Judge Claudia Wilken dismissed Kozumi's federal and state antitrust claims with prejudice. She also granted Ubiquiti's motion to dismiss implied covenant of good faith and fair dealing, defamation, tortious interference, and Unfair Competition Law claims. Kozumi's breach of contract claim is the sole counterclaim that remains in the case.
