Facts
On Nov. 7, 2010, Susmita Doshi and her husband, Sudhir, attended a party hosted by Shailesh Mukesh and Rupa Mehta at the home of Mahesh Vyas and Jayshree Vyas. Originally, the intention was for the party to be held outdoors, it was moved indoors due to the weather. Because of this change, the party was more crowded and left less walking room for the guests. As a result, Doshi fell into a large indoor swimming pol and fractured her left heel.
Doshi sued Mahesh Vyas, Jayshree Vyas, Shailesh Mukesh, and Rupa Mehta, alleging that they created a dangerous condition. Doshi contended that the congestion created by the indoor pool, tables, and significant number of people all created an environment where it was likely for guests to have difficulty delineating the boundaries of the pool. Another guest at the same party also fell into the pool shortly after Doshi's accident.
The defendants argued that the pool constituted an open and obvious hazard.
Damages
Doshi claimed past medical bills of $26,425.
Injuries
Doshi fractured her left heel, requiring an open reduction and internal fixation surgery.
Result
The parties settled for $57,000.
