Gary Grossman filed a representative complaint against the City of the Los Angeles Department of Water and Power in connection with the city's Multi-Family Bulky Item Fee.

Contentions

PLAINTIFF'S CONTENTIONS:
Grossman contended that the city unlawfully charged condominium dwellers with the Bulky Item Fee since September 2007.

Result

The parties agreed to settle the matter by providing for declaratory relief that the Bulky Item Fee was not applicable to condominium customers, and that those who were charged were charged improperly. The settlement also created a claims process under which affected condominium customers could seek a refund, if they have not yet previously received a refund. It also provided for $50,000 payment for attorney fees.
