New Hampshire Ball Bearings Inc. filed suit against National Union Fire Insurance Co. of Pittsburg PA, and Chartis Claims Inc.

Contentions

PLAINTIFF'S CONTENTIONS:
National Union issued an Employment Practices Liability Insurance policy to Ball Bearings, covering the period of June 2011 to June 2012. The policy was established to cover "employment practices violations."

In April 2012, Edgar Batres filed a class action against Ball Bearings, alleging various employment related causes of action. Ball Bearings tendered the suit to National Union for coverage, but National Union denied coverage because Batres' allegations did not match the employment practices violations covered by the policy.

Result

The court granted summary judgment for National Union.
