Stacy Rodriguez sued Rita Brown, based on an automobile accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Rodriguez claimed that on Feb. 6, 2010, she was driving, when a vehicle operated by Brown suddenly hit her. Plaintiff contended Brown had been exiting the freeway and trying to make a turn when she hit Rodriguez. Rodriguez claimed that Brown had been driving recklessly, and that she had driven through a red light.
DEFENDANT'S CONTENTIONS:
Brown contended that she had entered the intersection on a green light, and that Rodriguez had hit her. She claimed that Rodriguez caused the accident by attempting to pass her from behind. Brown argued that Rodriguez's injuries had not been serious, and that her treatment was entirely connected to her pre-existing condition, not the accident.
Injuries
Rodriguez claimed that the accident exacerbated a pre-existing condition in her back, and caused her to have to undergo physical therapy, surgery and epidural injections.
Result
The parties settled for $95,000.
