Contentions
PLAINTIFF'S CONTENTIONS:
Forensic Consultants claimed that in 2007, it attempted to renegotiate a contract with Stanislaus county. Forensic Consultants was under contract with the county to provide pathology services since 2005. However, the county later decided to terminate the contract and hired a replacement forensic pathologist. Forensic Consultants argued that these actions breached their contract and claimed that the county had no valid reason for terminating the contract.
DEFENDANT'S CONTENTIONS:
The county claimed it had valid reasons for terminating the contract, because its terms were no longer fiscally prudent. It further argued that the contract was invalid because it was an impermissible contract of adhesion.
Settlement Discussions
Forensic Consultants demanded $300,000 to settle.
