China National Shipbuilding Equipment & Materials (East China) Co. Ltd. sued Lalia and Iqbal Hemani, claiming fraud and unjust enrichment.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendants, the alleged founders of Lalani Steel Inc., failed to make payments under a debt repayment agreement entered into between the plaintiff and Lalani Steel.

DEFENDANTS' CONTENTIONS:
The Hemani's contended that the complaint should be dismissed for failure to state a claim because it did not contain specific factual allegations that rose to the level of fraud or unjust enrichment.

Result

The court granted defendants' motion to dismiss. It dismissed without prejudice plaintiff's claim for fraud and dismissed with prejudice its unjust enrichment claim.
