Facts

Kathleen Kelley rented residential property in Brookdale. She sued the property manager Scotts Valley Property Management and the owner of the property, Todd Sachi alleging premises liability.

Contentions

PLAINTIFF'S CONTENTIONS:
Kelley contended that she told defendants that the property had several defects, including deterioration of the exterior decks and stairways, mold and mildew growth and water intrusion but that they failed to remedy the defects. She claimed that she tripped and fell down five or six stairs due to protruding nails on the deck.

Injuries

Kelley claimed rib and soft-tissue injuries as well as respiratory injury and adult onset asthma.

Result

The parties settled for $30,000.
