Cirena Torres brought a class action lawsuit against retailer Kwong Yet Lung Co. Inc. dba International Marketplace for alleged violations of the Fair and Accurate Credit Transaction Act.
Contentions
PLAINTIFF'S CONTENTIONS:
Torres contended that defendant violated FACTA by providing herself and other customers with electronically printed receipts containing more than the last five digits of their credit or debit card number, the expiration dates of the cards, the brand of the card, and their names, in violation of FACTA.
DEFENDANT'S CONTENTIONS:
International Marketplace denied all of plaintiff's allegations including that it engaged in any willful misconduct.
Result
Per the settlement agreement reached between the parties, International Marketplace will distribute a minimum of 10,000 International Marketplace Gift Cards valued at $50 to eligible class members and agreed to institute a FACTA compliance policy.
