Susan Mallen, 53, and her husband William Mallen sued physician Matthew McAndrew, California Pacific Medical Center, and its operator Sutter Health, after Susan Mallen suffered a bacterial infection in her spine. Sutter West settled before trial.
William Mallen was later removed as plaintiff.
Contentions
PLAINTIFF'S CONTENTIONS:
Mallen contended that McAndrew committed medical malpractice because he failed to treat and diagnose an infection in Mallen's arm caused by an IV infiltration. Consequently, she claimed that the infection spread to her spine, causing constant back pain and requiring further treatment.
DEFENDANT'S CONTENTIONS:
McAndrew contended that Mallen's IV infiltration was routine and did not require antibiotics because it looked like a typical infiltration.
Damages
Mallen asked the jury to award her $6 million in damages.
Result
The jury found that McAndrew was not negligent, and returned a defense verdict.
