The State of California, by and through its Attorney General Kamala Harris, brought a complaint against Pratibha Syntex Ltd., an apparel manufacturing company located in India, for alleged violations of unfair competition law.
Contentions
PLAINTIFF'S CONTENTIONS:
Harris contended that Pratibha Syntex obtained an unfair cost advantage over competitors in California by using software programs owned by Adobe Systems Inc., Microsoft Inc. and others without paying for them.
DEFENDANT'S CONTENTIONS:
Pratibha Syntex contended, in part, that its demurrer should be sustained because California's unfair competition law could not be applied extraterritorially.
Result
Pursuant to the settlement reached between the parties, Pratibha Syntex will pay the State of California $100,000 and cease to use unlicensed software. It will also perform four audits of all software installed on its computer systems and will disseminate a yearly intellectual policy statement to its employees setting forth its commitment to only use licensed software.
