Facts

BMG Rights Management (US) LLC filed an infringement lawsuit against Internet service provider, Cox Communications Inc. and Coxcom LLC.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff accused defendants of infringing plaintiff's copyrighted works by facilitating customers' download of copyrighted works over the Internet. Plaintiff asserted claims for direct infringement, contributory infringement and vicarious liability.

DEFENDANTS' CONTENTIONS:
Defendants denied any wrongdoing. Defendants also asserted various affirmative defenses.

Result

The jury found Cox had infringed on BMG's copyrighted work and awarded BMG $25 million in statutory damages. The total amounts to about $18,000 for each song infringed.
