Evgeny Epikhin and Dmitri Redlikh sued defendants Game Insight North America Inc., Game Insight Global Limited dba Gigl, Cooper Media Corp. dba Game Insight, Game Garden LLC, Fly High Games, and Yury Pomortsev, in connection with Cat Story.

Contentions

PLAINTIFFS' CONTENTIONS:
Epikhin and Redlikh contended that their former business partners committed copyright infringement when they distributed the Cat Story game, which plaintiffs contended they owned. They claimed that they never gave defendants permission to reproduce, adapt, or distribute the game.

Plaintiffs asserted claims for copyright infringement, fraud, contributory copyright infringement, vicarious copyright infringement and breach of contract relating to the rights to Cat Story, a free mobile application.

DEFENDANTS' CONTENTIONS:
Defendants contended that they were entitled to dismissal because plaintiffs lacked valid copyright registration and because they were co-authors with one of the defendants of the infringing game.

Result

The court granted defendants' motion to dismiss.
