The accident occurred on Jan. 23, 2004, at the intersection of Erringer and Royal in Simi Valley. Defendant Thomas Kinch driving a pick-up truck ran a red light striking a bread truck, which was then pushed into the front end of the plaintiff’s sport utility vehicle, which was stopped at the intersection.
The plaintiff, a 37-year-old actor, contended that the accident caused two herniated discs in his lumbar spine and needed surgery.
The defendant admitted liability but disputed causation and the nature and extent of the injuries and damages.
