Facts

Defendant Christian Lehman drove a motorcycle on which plaintiff Julie Engell sat as a passenger. While Lehman and Engell were on the motorcycle, a vehicle made a left turn and hit the motorcycle at an intersection. Engell sued Lehman and the driver of the other vehicle for motor vehicle negligence. Lehman denied he was negligent. The driver of the other vehicle settled.

Settlement Discussions

The plaintiff demanded $100,000 (policy limits) and the defense made no offer.

Damages

$500,000 stipulated economic damages.

Injuries

Engell suffered an open fracture of the proximal tibia, a closed fracture of the distal tibia, and chronic pain following four surgeries.
