Facts

Plaintiff Damaris McCollins and his mother, plaintiff Carol Rivers, were standing outside Mount Zion Baptist Church at 1321 Oak Street in San Francisco on Sept. 17, 2006. Defendant Gloria Johnson reversed her vehicle and hit a nearby metal fence, which allegedly bent and struck McCollins in the eye.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that the defendant's negligence caused the fence to break and strike McCollins. Rivers claimed emotion distress due to witnessing this event.

Injuries

Plaintiffs claimed loss of vision and emotional distress.

Result

The plaintiffs settled with defendant for $325,000.
